Terms of Service
1. Introduction and Agreement
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Harbor Kapiten ("Harbor Kapiten", "we", "us", or "our"), governing your access to and use of our website, algorithmic trading models, technical interfaces, software tools, and related digital services (collectively, the "Services").
By accessing or interacting with Harbor Kapiten, you represent that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not consent to all provisions set forth herein, you must immediately discontinue your use of our Services.
2. Eligibility and Regulatory Scope
To access or utilize our Services, you must satisfy all of the following conditions:
- You are at least 18 years of age or the legal age of majority in your applicable jurisdiction.
- You possess the legal capacity to enter into an enforceable contract.
- You are not located in, a citizen of, or a resident of any territory or country subject to comprehensive international sanctions or where digital asset trading, automated execution, or algorithmic software is prohibited by law.
- You comply with all local laws, statutes, and regulatory frameworks applicable to your participation in financial markets and cryptographic transactions.
3. Nature of the Services & No Investment Advice
Harbor Kapiten operates strictly as an automated software and technical analytical interface. We provide algorithmic tools, mathematical models, market indicators, and connectivity frameworks designed to assist users in managing execution parameters across third-party exchanges and brokerage services.
4. Inherent Market Risks and Algorithmic Execution
Trading cryptocurrencies, foreign exchange, contracts for difference (CFDs), and other volatile financial instruments carries a substantial risk of financial loss. You acknowledge and accept the following inherent risks:
- Market Volatility: Asset prices fluctuate unpredictably due to market liquidity, geopolitical events, and technical factors, which may lead to total capital loss.
- Algorithmic Behaviour: Algorithmic strategies, automated bots, and machine learning models are reliant on historical statistical patterns and real-time feeds. Unforeseen market conditions or latency anomalies can result in adverse execution.
- Past Performance: Any historical backtests, hypothetical returns, or promotional indicators presented are not representative of guaranteed future results.
- Technological Latency: Downtime, network congestion, exchange API errors, and disconnects are outside our direct control and may impact order placement or liquidation stops.
5. User Account and Operational Responsibilities
Users are responsible for maintaining the confidentiality of any access credentials, API keys, or operational configurations tied to their engagement with Harbor Kapiten. You agree to notify us immediately of any unauthorised use or security compromise. You agree not to reverse-engineer, decompile, scrape, overload, or disrupt our technical infrastructure or attempt to gain unauthorised access to systems or code bases.
6. Third-Party Brokers and Service Integrations
Harbor Kapiten may facilitate routing, technical hooks, or referral pathways to autonomous third-party brokers, digital asset exchanges, or liquidity providers. We do not own, control, supervise, or endorse these third-party platforms. Your contractual relationship, funds, deposits, and trade executions are conducted exclusively between you and the designated broker under their independent terms and licensing regimes.
7. Intellectual Property
All intellectual property rights in the software, interfaces, visual styling, source code, data sets, brand names, and logos associated with Harbor Kapiten are owned by or licensed to Harbor Kapiten. You are granted a limited, revocable, non-exclusive, non-transferable license to access the platform solely for personal trading operations in compliance with these Terms.
8. Limitation of Liability
To the fullest extent permitted by the laws of England and Wales, Harbor Kapiten, its directors, employees, affiliates, and technology partners shall not be held liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, lost capital, loss of data, system downtime, or exchange failure arising from your use of or inability to use the Services.
9. Governing Law and Jurisdiction
These Terms, their subject matter, and their formation shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any dispute, controversy, or claim arising under or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
10. Modifications and Termination
We reserve the right to revise or update these Terms at any time to reflect software changes, regulatory requirements, or security best practices. Updated versions will be published with a revised effective date. Your continued interaction with Harbor Kapiten constitutes acceptance of modified terms.
